1. Acceptance of Terms

By accessing or using TheTopXList at thetopxlist.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

TheTopXList is a platform that allows users to create, share, and vote on ranked lists. The Service is provided "as is" and "as available" without warranties of any kind.

3. Accounts

To create content on the Service, you must sign in using a Google account. You are responsible for all activity that occurs under your account. You agree to:

  • Provide accurate information
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Responsibility

You are solely responsible for the content you create, including list titles, descriptions, images, and rankings. You represent and warrant that:

  • You own or have the right to use all content you submit
  • Your content does not infringe any third-party intellectual property rights
  • Your content does not contain illegal, defamatory, hateful, or obscene material
  • Your content does not violate any applicable laws or regulations

4.2 License

By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service. You retain all ownership rights to your content.

4.3 Moderation

All submitted lists are reviewed before publication. We reserve the right to reject, remove, or modify any content at our sole discretion, including content that violates these Terms or that we deem inappropriate.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit spam, misleading, or fraudulent content
  • Manipulate the voting system (e.g., using bots, multiple accounts, or automated tools)
  • Attempt to access other users' accounts or private data
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or otherwise extract data from the Service in an automated manner without permission
  • Upload malicious code, viruses, or harmful content

6. Intellectual Property

The Service, including its design, code, logos, and branding (excluding user content), is owned by TheTopXList and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.

7. Third-Party Links & Images

User content may contain links to external websites or images from third-party sources. We are not responsible for the content, accuracy, or practices of any third-party websites or resources.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THETOPXLIST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER CAUSED BY TORT, BREACH OF CONTRACT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless TheTopXList and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Account Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by the laws of the European Union and the member state where the operator resides, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
